Refund Policy

This Refund Policy explains how refunds work for subscriptions to the tools and services provided by Daniel & Sons Mining Consulting ("we", "us", "our"). It forms part of our Terms of Use. Nothing in this policy excludes or limits any rights you have under the Australian Consumer Law.
1. Free Trial — Try Before You Buy
We offer a 7-day free trial of the Circuit Design Suite (Tier 3) so you can evaluate the platform before paying anything. If you cancel at any time during the trial via Manage Billing on your dashboard, you will not be charged. Because the trial exists so you can try the service first, we generally do not offer change-of-mind refunds after a trial converts to a paid subscription.
2. Duplicate Charges & Billing Errors
If you are charged twice for the same subscription period, charged an incorrect amount, or charged after cancelling in accordance with our Terms, we will refund the erroneous charge in full — always, no questions asked. Contact us with the details and we will correct it promptly.
3. Service Failures
If a fault on our side — such as extended unavailability of the platform or a defect that substantially prevents you from using the tools included in your tier — materially affects your subscription, we may provide a pro-rata refund at our discretion for the affected period. This discretion does not limit any remedy you are entitled to under the Australian Consumer Law (see section 6).
4. Cancellations
You can cancel your subscription at any time via Manage Billing on your dashboard. Cancelling stops all future charges, and your access continues until the end of the period you have already paid for. Except as set out in this policy or required by law, we do not refund the unused remainder of a billing period.
5. How to Request a Refund
Email mike.daniel@cmdconsulting.com.au with:
- The email address on your account
- The date and amount of the charge
- Your invoice or receipt number, if available
- A brief description of the issue
We aim to respond within 5 business days. Approved refunds are issued to your original payment method via Stripe and typically appear within 5–10 business days, depending on your bank.
6. Your Rights Under the Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion. Nothing in this policy excludes, restricts, or modifies those rights.
